Terms and conditions Cataned Turistic SL

While using and accessing www.apartments2stay.nl and www.apartments2stay.com websites (hereinafter referred to as Cataned Turistic SL), the following terms and conditions apply:

Definitions

Agreement for intermediation:
The order to Cataned Turistic SL to intermediate in accomplishing an agreement intended for the use of the apartment between the customer and the owner.

Customer:
The person who orders Cataned Turistic SL to intermediate in the accomplishment of an agreement; and/or
The person on whose behalf, but in order of a third party, Cataned Turistic SL intermediated and who accepted the accomplished agreement(s).

Owner:
The person or legal entity that with the intervention of Cataned Turistic SL supplies costumer with apartment for temporary use.

Pre payment:
Amount charged by Cataned Turistic SL for its intermediation services which costs are due from the customer to Cataned Turistic SL.

Administration costs:
The costs which are charged by Cataned Turistic SL for settling all payments with internet banking, credit cards, IDEAL and Pay Pal.
These costs will be charged as well for sending extra invoices to customers and companies. This fee is not a part of the rent

Apartment expenses:
The balance remaining of the total cost (rent + cleaning), which will be charged by the owner for the use of the apartment by the customer. This costs will be paid cash upon arrival in the apartment.

Prices:
The amounts, given by Cataned Turistic SL, are per night in Euros unless stated otherwise.

Services by Cataned Turistic SL

:
Cataned Turistic SL will help the customers to determine whether the apartment as requested by the customer is available and will act as a mediator between the customer and the owner.
Cataned Turistic SL will attempt to make a reservation at the requested apartment for the customer.
The intermediation by Cataned Turistic SL consists of (the attempt) to bring about an agreement between the customer and the owner.
Cataned Turistic SL itself is not a party to the agreement that is brought about between the customer and the owner; Cataned Turistic SL merely intermediates.

Agreement for intermediation; customers:

The agreement for intermediation will be effectuated by the entry of a request, either by telephone, by fax, by e-mail or by means of the reservation form on the website, followed by a written confirmation by Cataned Turistic SL by letter, e-mail or fax. By entry of such a request or booking/reservation order, the customer declares to know and to accept these conditions. The forwarding of personal data by a customer clearly indicates the existence of a request or order and consequently the agreement with these conditions.

The customer will forward any data about himself, herself or other people in the party (such as nationality and other particulars) to Cataned Turistic SL as far as needed for- or could be of influence on the execution of the agreement with Cataned Turistic SL or the owners.

The customer guarantees that the name, email address, postal address, passport number and/or other personal data which Cataned Turistic SL deems necessary are correct and accurate and agrees that Cataned Turistic SL will use these data in order to contact the customer if this appears to be necessary.

The one who enters into a reservation agreement with Cataned Turistic SL for himself, herself and/or for others is personally responsible for any obligations resulting from these agreements.

The prices given by Cataned Turistic SL or confirmed by him on behalf of a owner, are based on rates, conditions, taxes etc. as known to Cataned Turistic SL on accomplishment of the agreement. Cataned Turistic SL is allowed to change this information on the website when changes occur.

Reservations, check in, check out and deposits

To reserve the apartment a pre-payment of the total cost of the stay is required.

This pre-payment should be made by bank transfer or credit card. In this case, banking charges must be paid by customer and should be not deducted from payment.

Upon receipt of pre-payment a contract confirming the reservation will be sent with other information such as the address of the apartment, how to get there, the balance remaining, contact telephone number.

The balance remaining plus the cleaning fee and the refundable deposit is in cash upon arrival day.

The standard check in is from 15:00 pm.
If the check in can be earlier then Cataned Turistic SL inform the client on time.

Note: arrivals or departures later then 21:00 pm or before 08:00 am there is an extra charge of 30 euro.

Check out is at 11:00am

The refundable deposit will be returned upon departure if there is no damage and the apartment is in the same condition as by arrival.

Note that the reservation will be not confirmed until Cataned Turistic SL receives the pre-payment amount and you have received a confirmation mail from us.

Cataned Turistic SL shall not be responsible for the transportation of the customer to and from the apartment.

Payment

As mentioned above, the pre-payment of the total rental cost will be required by means of a bank transfer or credit card payment.

The rest of the price for the stay in the apartment should be paid by the client in Cash upon arrival in local currency (euros). Please, remember (No cash, No check in).

The customer acknowledges that the owner will prohibit the access and use of the apartment in the event that the customer has not fully paid the apartment expenses as referred to.

Cataned Turistic SL will in no way whatsoever be held liable for this by the customer.

Cancellation

When a customer cancels an already full paid pre payment for an apartment by Cataned Turistic SL, the minimum charge at cancellation is:

• 100% of the total prepayment by cancelation less then 23 working days before the arrival date.
• 50% of the total prepayment by cancelation more then 23 working days before the arrival date.

Cataned Turistic SL recommends that the client purchase travel insurance with cancellation cover

The prepayments will be paid back by a bank transfer.

Cataned Turistic SL is entitled to terminate the agreement without any obligation for compensation to the customer, when observing the agreement is impossible or hampered by circumstances, which cannot be blamed to Cataned Turistic SL. In such cases of force majeure Cataned Turistic SL shall be held to restitution any already paid and received reservation costs. This costs will be paid back by a bank transfer.

When the owner cancels the apartment, the customer will be entitled to a refund of the reservation costs. However at the request of the customer Cataned Turistic SL will make an effort to mediate for an alternative apartment for the customer, without the latter being held to any payment of reservation costs to Cataned Turistic SL.

In the event that the customer notifies Cataned Turistic SL not to exercise this option, while the customer has already part (part of) the reservation costs to Cataned Turistic SL, Cataned Turistic SL will refund (this part of) the reservation costs to the customer by a bank transfer.

Contents website and complaints

Cataned Turistic SL has composed the contents of the website with the outmost care. However all information (descriptions, calendars, prices and photographs) on the website in relation to the apartment originates from the owners. These owners are responsible for the accuracy and completeness of this information.

Any complaints regarding the apartment must be notified to the relevant representative of the owner during the stay at the apartment and will be taken up by the owner. If the customer fails to get satisfaction from the representative/owner and contacts Cataned Turistic SL, Cataned Turistic SL will make sure to inform the owner of the complaint without neither guaranteeing or taking responsibility for the standard of neither apartment or being held to investigate the soundness of the complaint.

Liability

Cataned Turistic SL accepts neither liability for actions and/or negligence of owners, or for the correctness of information given by them.

As far as nevertheless Cataned Turistic SL can still be seriously blamed for any action, which caused provable damage to the customer, the liability of Cataned Turistic SL is limited to the charged costs.

Cataned Turistic SL will in no event be responsible for indirect damages, including consequential damages, loss of profit, lost savings, damages due to discontinuation and damages due to loss of data. Excluded are the liabilities for damages that are commonly covered by travel insurance, as well as those that are related to customers’ profession or business.

Governing law; competent courts

On all agreements with Cataned Turistic SL the law of the Netherlands will apply on an exclusive basis. The applicability of the Treaty of Vienna is hereby excluded.

The courts of Barcelona (Spain) will have an exclusive jurisdiction in disputes between customers and Cataned Turistic SL. However, if Cataned Turistic SL deems it appropriate, Cataned Turistic SL will have the right to initiate legal proceedings in the domicile of the customer
